Gigabyte: Asus Lied & Fooled Customers
...
According to Asus’ own documents, motherboards labeled with an EPU logo contain an "Asus Energy Processing Unit." Essentially, these motherboards are supposed to contain components designed specifically to lower power consumption and provide better electrical efficiency throughout — there’s really no logical "processor" involved. Asus claims that EPU motherboards can deliver up to 80.23-percent "power savings" from motherboards without EPU components.

At this point, Gigabyte claims that there are no truths to Asus’ claims of 80.23-percent, and in fact is more realistic at 58.6-percent. Gigabyte says that Asus made no changes to its motherboards via firmware, design or component changes — only numbers were changed on product advertisement and packaging. Gigabyte noted that Asus was "playing numbers marketing" and "cheating end users."

I must admit, I quite like Gigabytes management style...

And they arguably make superior motherboards to Asus anyway IMHO at least for the last couple of years or so.
It's probably true that Gigabyte motherboards generally use better quality capacitors than their competitors, i've seen the differences myself with my own eyes. All the caps on my current board are Fujitsu branded solids.

Asus customer service is still downright shoddy too, nothing much has changed there unfortunately it seems.

But even if Asus boards are not exactly what they say on the box, they are still pretty reliable all the same, chances are that the motherboard will last as long as your system will.

The only reason I have to like ASUS is that they're pushing new standards, cdroms with SATA, audio cards with PCI Express, stuff that established solutions are (or were) still not doing. Otherwise, I've never really had any reason to consider them. Gigabyte does seem to put out quality.

ASUS prepping to sue Gigabyte over "disinformation"

ASUS is firing up the legal team to address what it percieves as defamation on the part of Gigabyte. In the line of fire is ASUS' Energy Processing Unit, which Gigabyte claims isn't a technological change on the part of ASUS, but instead "numbers marketing" and "cheating end users." Gigabyte says ASUS also misrepresented the energy saving numbers on Gigabyte's competing DES motherboards, and had plenty of other nerdy trash talk for its rival.

Gigabyte's Official Response To Asus

Gigabyte today released an official public statement to Tom’s Hardware, indicating that the company stands by its tests results and claims made against Asus. Asus released an official statement on its website last week, indicating that Gigabyte made false claims, and that Asus would pursue legal action. In fact, Asus’ statement said it would go after anyone who would spread negative "rumors" about Asus and its products.

Gigabyte told Tom’s Hardware:

GIGABYTE UNITED INC., a leading manufacturer of motherboards and graphics cards would like to respond to recent statements by our competitor alleging GIGABYTE has made false claims against them. These statements were made in response to a report GIGABYTE detailed for the media which compared GIGABYTE’s 4-Gear and 6-Gear Dynamic Energy Saver technology to our competitor’s non-phase change and 2-Gear Phase changing energy saving technology. In addition, direct comparisons and testing results were reported between the GIGABYTE GA-EP35-DS3L motherboard and our competitor’s P5K-SE EPU.

In the original comparison, an Asus P5K-SE motherboard was used for comparison. But Asus mentioned a P5Q motherboard based on a new chipset, and is in fact, not yet released. Tom’s Hardware is asking Asus for a response on the P5K-SE motherboard used in the comparison, and not an unrelated P5Q.

Its escalating:
The fight between ASUS and Gigabyte took a nasty, but not unexpected, turn Friday when Asus filed a defamation lawsuit against Gigabyte while also filing a complaint with the Fair Trade Commission of Taiwan.
